Privacy Policy

Land of Land, Inc. (”Company“) recognizes that its visitors, users, and bidders (collectively, “Users”, “You” or “Your”) of the Company’s Online Auctions and website (the “Company Sites”) value their privacy. This Privacy Policy describes important information regarding the use and disclosure of User information collected on the Company Sites.

Any personal information (“Information”) Users provide on the Company Sites remains subject to the terms of this Privacy Policy, and any agreements between User and Company such as Auction Terms and Conditions.

Company has the legal right to use Information in the ways described in this Privacy Policy based on User consent, or on the need to use the Information to provide You with land and services, or for furthering Company’s existing relationship with User or for preventing fraud.  Users who do not provide Information may be unable to use the Company Sites or to purchase land and services.

1. COMPANY SITE INFORMATION

A. The Information Company Collects from Company Sites


1. User-Provided Information: When a User registers on Company Sites, certain Information (personally identifiable information such as name and email address) is provided to Company. Additional Information may be collected by Company when You send e-mails or other messages to Company, and when You bid on Lots or inquiring about land.


2. Cookies Information: When You visit the Company Sites, we may send one or more cookies – a small text file containing a string of alphanumeric characters – to Your computer that uniquely identifies Your browser. Company uses both session cookies and persistent cookies. A persistent cookie remains after You close Your browser. Persistent cookies may be used by Your browser on subsequent visits to the site. Persistent cookies can be removed by following Your web browser help file directions. A session cookie is temporary and disappears after You close Your browser. You can reset Your web browser to refuse all cookies or to indicate when a cookie is being sent. Some features of the Company Sites, However, may not function properly if the ability to accept cookies is disabled.


3. Log File Information: When You use the Company Sites, Company servers automatically record certain information that Your web browser sends whenever You visit any website. These server logs may include information such as Your Internet Protocol (”IP“) address, browser type, browser language, referring/exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed, the amount of time spent on particular pages, the date and time of usage, and one or more cookies that may uniquely identify Your
browser.


4. Clear GIFs Information: When Users use the Company Sites, Company may employ “clear GIFs” (a.k.a. Web Beacons) which are used to track the online usage patterns of our Users anonymously (i.e., in a non-personally-identifiable manner). In addition, Company may also use clear GIFs in HTML-based emails sent to our users to track which emails are opened by recipients.

B. The Way Company Uses Information


1. If Users submit Information through the Company Sites, then Company uses Your Information to operate, maintain, and provide to You the features and functionality of the Company Sites.


2. Company may use User Information to contact User regarding available land or services for customer service purposes. Users will have the ability to opt-out of such contacts.


3. Company uses Information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Company Sites and to create new features, promotions, functionality and services .


4. Company use cookies, clear gifs, and log file information to: (a) remember information so that User will not have to re-enter it during subsequent visits to the Company Sites; (b) provide custom, personalized content and information; (c) monitor the effectiveness of Company marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track User entries, submissions, and status in promotions,
sweepstakes, and contests.

C. When Company Discloses Information


1. We may provide Information and non-personally-identifiable information to third parties for the purpose of processing such information on our behalf. We require that these parties agree to process such information solely on our behalf, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.


2. We may share non-personally-identifiable information (such as anonymous User usage data, referring / exit pages and URLs, platform types, number of clicks, etc.) with interested third-parties to assist them in understanding the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Company Sites.


3. We may release personally identifiable information and/or non-personally-identifiable information if required to do so by law, or in the good-faith belief that such action is necessary to comply with state, federal and international laws or respond to a court order, subpoena, or search warrant.


4. Company also reserves the right to disclose personally identifiable information and/or non-personally-identifiable information that Company believes, in good faith, is appropriate or necessary to enforce our Terms and Conditions or other agreements, take precautions against liability, to investigate and defend itself against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of our web site, and to protect the rights, property, or personal safety of Company, our Users or others.

2. YOUR CHOICES ABOUT PRIVACY

You may decline to submit personally identifiable information through the Company Sites, in which case
Company may not be able to provide certain services to You. You are responsible for maintaining the

3. OUR COMMITMENT TO DATA SECURITY

1. Company uses commercially reasonable security devices to preserve the integrity and security
of Your personal information. We cannot, however, ensure or warrant the security of any information
You transmit to Company and You do so at Your own risk. Once we receive Your transmission of
information, Company makes commercially reasonable efforts to ensure the security of our systems.
However, please note that this is not a guarantee that such information may not be accessed, disclosed,
altered, or destroyed by breach of any of our security safeguards.


2. If Company learns of a security systems breach, then we may attempt to notify You
electronically so that You can take appropriate protective steps. Company may post a notice on the
Company Sites if a security breach occurs. Depending on where You live, You may have a legal right to
receive notice of a security breach in writing.

4. IN THE EVENT OF MERGER, SALE, OR BANKRUPTCY

In the event that all or part of Company is acquired by or merged with a third party entity, You agree that
we may, in any of these circumstances, transfer or assign the information we have collected from our
Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our
bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the
application of laws or equitable principles affecting creditors’ rights generally, we may not be able to
control how Your personal information is treated, transferred, or used.

5.CHANGES AND UPDATES TO THIS PRIVACY POLICY

1. This Privacy Policy may be revised periodically, as reflected by the “effective date” below. Your
continued use of the Company Sites constitutes Your agreement to this Privacy Policy and any future
revisions.
